A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use and safety of certain types of motorcycles and |
|
the establishment of a training requirement for the use of such |
|
motorcycles; providing a penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle G, Title 7, Transportation Code, is |
|
amended by adding Chapter 664 to read as follows: |
|
CHAPTER 664. HIGH-PERFORMANCE MOTORCYCLE TRAINING |
|
Sec. 664.001. DEFINITIONS. In this chapter: |
|
(1) "Motorcycle" has the meaning assigned by Section |
|
502.001 and includes a motorcycle equipped with a sidecar. |
|
(2) "Operator" has the meaning assigned by Section |
|
541.001. |
|
(3) "Owner" has the meaning assigned by Section |
|
541.001. |
|
(4) "High-performance motorcycle" means a motorcycle |
|
with a weight-to-power ratio of less than 3-1/2 pounds per |
|
horsepower, as determined by referencing the data contained on the |
|
manufacturer's certificate of origin for the motorcycle and |
|
dividing the motorcycle's dry shipping weight by its Society of |
|
Automotive Engineers net horsepower as shown on the manufacturer's |
|
certificate of origin. |
|
Sec. 664.002. (a) Each owner and operator of a |
|
high-performance motorcycle purchased on or after September 1, |
|
2009, is required to take the training described by Chapter 662 |
|
within 180 days of the purchase of the motorcycle. Proof of |
|
successful completion of the training must be carried by the |
|
operator of a motorcycle purchased on or after September 1, 2009, |
|
and produced on demand of any peace officer of this state. |
|
(b) An offense under this section is a Class C misdemeanor. |
|
SECTION 2. This Act takes effect September 1, 2009. |
