A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use and safety of certain types of motorcycles, the |
|
establishment of a training requirement for the use of such |
|
motorcycles, and providing a penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Title 7, Subtitle G, Transportation Code, is |
|
amended by adding Chapter 664 to read as follows: |
|
HIGH-PERFORMANCE MOTORCYCLE TRAINING |
|
Sec. 664.001. DEFINITIONS. In this chapter: |
|
(1) "Motorcycle" has the meaning assigned that term by |
|
Section 502.001, and includes a motorcycle equipped with a sidecar. |
|
(2) "Operator" has the meaning assigned that term by |
|
Sec. 541.001. |
|
(3) "Owner" has the meaning assigned that term by Sec. |
|
541.001. |
|
(2) "High-performance motorcycle" means any |
|
motorcycle referred to, called, labeled, or described as a "sports |
|
bike", "sports motorcycle", "high performance motorcycle", or |
|
other similar term, in any materials given to an original purchaser |
|
at the time of purchase from any dealership or retail seller of such |
|
motorcycle, or contained in the owners manual or guides from the |
|
manufacturer of such motorcycle, whether or not actually delivered |
|
to the purchaser. |
|
Sec. 664.002. All owners and operators of a high |
|
performance motorcycle purchased on or after September 1, 2009, are |
|
required to take the training described under Title 7, Subtitle G. |
|
Chapter 662, Transportation Code within 180 days of the purchase of |
|
such motorcycle. Proof of such attendance must be maintained by the |
|
operator of such motorcycles and must be produced upon demand of any |
|
law enforcement or peace officer of the state. |
|
Sec. 664.004. An offense under this chapter is punishable |
|
by a fine of not less than $500 (five hundred dollars) and not more |
|
than $1000 (one thousand dollars). |
|
SECTION 2. This act takes effect September 1, 2009. |
