A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the training requirements for surveyors of certain |
|
|
long-term care facilities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 22.039, Human Resources Code, is amended |
|
|
by amending Subsection (b) and adding Subsection (b-1) to read as |
|
|
follows: |
|
|
(b) The department shall require a surveyor to complete a |
|
|
basic training program before the surveyor inspects, surveys, or |
|
|
investigates a long-term care facility. The training must include |
|
|
observation of the operations of a long-term care facility |
|
|
unrelated to the survey, inspection, or investigation process for a |
|
|
minimum of 10 working days [within a 14-day period]. |
|
|
(b-1) The department shall waive the observation |
|
|
requirement under Subsection (b) for a surveyor who has been |
|
|
employed in a long-term care facility within five years of the date |
|
|
the person assumes duties as a surveyor. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
