A BILL TO BE ENTITLED
 
AN ACT
  relating to the powers and duties of the Legislative Budget Board,
  including the receipt of reports by the board.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 316, Government Code, is
  amended by adding Section 316.010 to read as follows:
         Sec. 316.010.  ADJUSTING THE COMPOSITION OF FUND AND ACCOUNT
  BALANCES. (a)  The comptroller may, as necessary to ensure
  compliance with the limit on the rate of growth of appropriations
  prescribed by Section 22, Article VIII, Texas Constitution, adjust
  the composition of fund and account balances without making any net
  change in the amount of a fund or account balance and without
  changing the amount of an appropriation.
         (b)  The comptroller shall report any adjustment made under
  Subsection (a) to the Legislative Budget Board.
         SECTION 2.  Section 2054.102(a), Government Code, is amended
  to read as follows:
         (a)  The Legislative Budget Board may specify procedures for
  the submission, review, approval, and disapproval of biennial
  operating plans and amendments, including procedures for review or
  reconsideration of the Legislative Budget Board's disapproval of a
  biennial operating plan or biennial operating plan amendment. [The
  Legislative Budget Board shall review and approve or disapprove the
  biennial operating plan or biennial operating plan amendment not
  later than the 60th day after the date the plan or amendment to the
  plan is submitted. The plan or amendment to the plan is considered
  to be approved on the 61st day after the date the plan or amendment
  is submitted if the Legislative Budget Board does not disapprove
  the plan or amendment before that date.]
         SECTION 3.  Section 19.0041, Education Code, is amended to
  read as follows:
         Sec. 19.0041.  EVALUATION OF TRAINING SERVICES.  (a)  To
  evaluate the effectiveness of training services provided to persons
  confined or imprisoned in the department, the Windham School
  District shall consult with the Criminal Justice Legislative
  Oversight Committee [Legislative Budget Board] to compile and
  analyze information for each person who receives the training
  services.  This information shall include an evaluation of:
               (1)  the kind of training services provided;
               (2)  the kind of employment the person obtains on
  release;
               (3)  whether the employment was related to training;
               (4)  the difference between the amount of the person's
  earnings on the date employment is obtained following release and
  the amount of those earnings on the first anniversary of that date;
  and
               (5)  the retention factors associated with the
  employment.
         (b)  The district [Legislative Budget Board] shall submit an
  annual report to the Criminal Justice Legislative Oversight
  Committee, [legislature and] the governor's office, and the
  Legislative Budget Board based on data compiled and analyzed under
  Subsection (a).
         SECTION 4.  Not later than December 1, 2009, the Windham
  School District shall submit the first report to the Criminal
  Justice Legislative Oversight Committee, the governor's office,
  and the Legislative Budget Board as required by Section 19.0041(b),
  Education Code, as amended by this Act.
         SECTION 5.  Section 322.016(b), Government Code, is
  repealed.
         SECTION 6.  This Act takes effect September 1, 2009.
