A BILL TO BE ENTITLED
 
AN ACT
  relating to making supplemental appropriations and giving
  direction and adjustment authority regarding appropriations.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  HEALTH AND HUMAN SERVICES COMMISSION: MEDICARE
  PART D GIVEBACK PAYMENT. In addition to amounts previously
  appropriated for the state fiscal biennium ending August 31, 2009,
  the amount of $332,378,835 is appropriated out of the general
  revenue fund to the Health and Human Services Commission for the
  two-year period beginning on the effective date of this Act for the
  purpose of providing the Giveback Payment to the federal government
  pursuant to federal law related to the implementation of the
  Medicare Part D prescription drug benefit.
         SECTION 2.  TEXAS DEPARTMENT OF CRIMINAL JUSTICE:
  OPERATIONS. In addition to amounts previously appropriated for the
  state fiscal biennium ending August 31, 2009, the amount of
  $157,500,000 is appropriated out of the general revenue fund to the
  Texas Department of Criminal Justice for the two-year period
  beginning on the effective date of this Act for the purpose of
  providing for salaries and wages, hazardous duty and longevity pay,
  overtime pay, food for wards of the state, contracted temporary
  capacity, utilities, and fuel.
         SECTION 3.  CANCER PREVENTION AND RESEARCH INSTITUTE:
  OPERATIONS. (a) In addition to amounts previously appropriated for
  the state fiscal biennium ending August 31, 2009, the amount of
  $2,120,294 is appropriated out of the general revenue fund to the
  Cancer Prevention and Research Institute for the two-year period
  beginning on the effective date of this Act for the purpose of
  providing for contracts, salaries and wages, travel, and
  acquisition of information technology, computers, furniture, and
  legal counseling.
         (b)  In addition to the number of full-time equivalent
  employees (FTEs) the Cancer Prevention and Research Institute is
  authorized by other law to employ during the state fiscal year
  ending August 31, 2009, the institute may employ an additional 33
  FTEs during that state fiscal year.
         SECTION 4.  EFFECTIVE DATE. This Act takes effect
  immediately.
