A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a state purchasing preference for certain |
|
|
pharmaceutical manufacturers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 2155, Government Code, is |
|
|
amended by adding Section 2155.454 to read as follows: |
|
|
Sec. 2155.454. PREFERENCE FOR CERTAIN PHARMACEUTICAL |
|
|
MANUFACTURERS. A state agency that expends appropriated money to |
|
|
purchase pharmaceutical products may give preference to a |
|
|
manufacturer of pharmaceutical products that voluntarily |
|
|
participates in: |
|
|
(1) the vendor drug program for the Department of |
|
|
State Health Services' Children with Special Health Care Needs |
|
|
Services Program; or |
|
|
(2) the Department of State Health Services' Kidney |
|
|
Health Care Program. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
