A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an additional fine for the violation of a municipal |
|
|
rule, ordinance, or police regulation to be used to support |
|
|
municipal parks. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 54, Local Government Code, |
|
|
is amended by adding Section 54.007 to read as follows: |
|
|
Sec. 54.007. ADDITIONAL FINE TO SUPPORT MUNICIPAL PARKS. |
|
|
(a) A municipality shall assess an additional fine for each |
|
|
violation of a municipal rule, ordinance, or police regulation in |
|
|
an amount of 10 percent of the fine originally assessed, but not |
|
|
less than $10. |
|
|
(b) The additional fine must be used to support municipal |
|
|
parks. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a violation committed on or after the effective date of this Act. |
|
|
A violation committed before the effective date of this Act is |
|
|
governed by the law in effect when the violation was committed, and |
|
|
the former law is continued in effect for that purpose. For |
|
|
purposes of this section, a violation was committed before the |
|
|
effective date of this Act if any element of the violation occurred |
|
|
before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
