A BILL TO BE ENTITLED
 
AN ACT
  relating to physical examination requirements for participation in
  extracurricular athletic activities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 33, Education Code, is
  amended by adding Section 33.093 to read as follows:
         Sec. 33.093.  PHYSICAL EXAMINATION REQUIRED FOR
  PARTICIPATION IN EXTRACURRICULAR ATHLETIC ACTIVITY.  (a)  In this
  section:
               (1)  "Advanced practice nurse" means a registered nurse
  approved by the Texas Board of Nursing to practice as an advanced
  practice nurse as provided by Section 301.152, Occupations Code.
               (2)  "Physician" means a physician licensed under
  Subtitle B, Title 3, Occupations Code.
               (3)  "Physician assistant" means a person who is
  licensed under Chapter 204, Occupations Code.
         (b)  A student may not participate in an extracurricular
  athletic activity, including an athletic practice, scrimmage,
  game, or match, sponsored or sanctioned by the University
  Interscholastic League unless the student has submitted to the
  school district the student attends a completed form indicating
  that the student has received a physical examination conducted by a
  physician, physician assistant, or advanced practice nurse.  The
  form must:
               (1)  be signed by the physician, physician assistant,
  or advanced practice nurse; and
               (2)  include a statement that, based on the
  examination, the physician, physician assistant, or advanced
  practice nurse has determined that the student does not have a
  medical condition that would make participation in the athletic
  activity hazardous for the student.
         (c)  The University Interscholastic League shall adopt rules
  to administer this section.
         SECTION 2.  This Act applies beginning with the 2009-2010
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
