A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the ability of certain hospitals to employ physicians. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 241, Health and Safety |
|
|
Code, is amended by adding Section 241.0051 to read as follows: |
|
|
Sec. 241.0051. EMPLOYMENT OF PHYSICIANS. A hospital |
|
|
located in a county with a population of less than 100,000 that |
|
|
borders the United Mexican States may employ physicians or other |
|
|
health care providers as the hospital considers necessary for the |
|
|
efficient operation of the hospital. This section may not be |
|
|
construed as authorizing the hospital to supervise or control the |
|
|
practice of medicine, as prohibited by Subtitle B, Title 3, |
|
|
Occupations Code. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
