A BILL TO BE ENTITLED
 
AN ACT
  relating to allowing a commissioner's court to assess a body
  storage fee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section Article 49.25, Code of Criminal
  Procedure, is amended by adding Section 10c to read as follows:
  Body Storage Fee
         Sec. 10c.  The commissioner's court may assess a fee not to
  exceed fifty dollars per day when a body is left at the medical
  examiner's office more than 24 hours after a release has been
  executed, except in an area of the state declared a Disaster Area by
  the governor of the State of Texas.
         SECTION 2.  This Act takes effect September 1, 2009.
