A BILL TO BE ENTITLED

AN ACT
|

|
relating to allowing a commissioner's court to assess a body |
|
|
storage fee. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section Article 49.25, Code of Criminal |
|
|
Procedure, is amended by adding Section 10c to read as follows: |
|
|
Body Storage Fee |
|
|
Sec. 10c. The commissioner's court may assess a fee not to |
|
|
exceed fifty dollars per day when a body is left at the medical |
|
|
examiner's office more than 24 hours after a release has been |
|
|
executed, except in an area of the state declared a Disaster Area by |
|
|
the governor of the State of Texas. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
