A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to restrictions on charges imposed on owners by or on |
|
|
behalf of certain property owners' associations. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 209, Property Code, is amended by adding |
|
|
Section 209.014 to read as follows: |
|
|
Sec. 209.014. RESTRICTIONS ON CERTAIN CHARGES. A property |
|
|
owners' association, an agent of the association, a management |
|
|
company, or an agent of the company may charge an owner only the |
|
|
actual costs incurred by the association, agent, or company to: |
|
|
(1) notify an owner of a violation of a restriction, |
|
|
bylaw, rule, or guideline of the association, other than those that |
|
|
involve payment of assessments; or |
|
|
(2) cure a violation of any restriction, bylaw, rule, |
|
|
or guideline of the association. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
