A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the powers of the board of port commissioners of the |
|
Port of Port Arthur Navigation District of Jefferson County, Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 2, Chapter 197, Acts of the 58th |
|
Legislature, Regular Session, 1963, is amended by adding Subsection |
|
(m) to read as follows: |
|
(m) The Board of Port Commissioners has absolute control |
|
over channels or other waterways within the corporate limits of the |
|
district, including turning basins, yacht basins, and storage |
|
basins. The district may prevent or remove any obstructions of |
|
those facilities and may set appropriate fees, charges, and tolls |
|
for their use. The fees, charges, and tolls charged by the district |
|
shall be in addition to charges made, as provided by law, for any |
|
facilities used by any ship, boat, vessel, or any other character of |
|
craft used for water transportation for commercial purposes. For |
|
purposes of this subsection, "commercial purposes" is limited to |
|
any common carrier, contract carrier, or public or private carrier |
|
that transports for hire or compensation persons, commodities, |
|
goods, wares, or merchandise. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
