A BILL TO BE ENTITLED
 
AN ACT
  relating to the powers of the board of port commissioners of the
  Port of Port Arthur Navigation District of Jefferson County, Texas.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 2, Chapter 197, Acts of the 58th
  Legislature, Regular Session, 1963, is amended by adding Subsection
  (m) to read as follows:
         (m)  The Board of Port Commissioners has absolute control
  over channels or other waterways within the corporate limits of the
  district, including turning basins, yacht basins, and storage
  basins. The district may prevent or remove any obstructions of
  those facilities and may set appropriate fees, charges, and tolls
  for their use. The fees, charges, and tolls charged by the district
  shall be in addition to charges made, as provided by law, for any
  facilities used by any ship, boat, vessel, or any other character of
  craft used for water transportation for commercial purposes.  For
  purposes of this subsection, "commercial purposes" is limited to
  any common carrier, contract carrier, or public or private carrier
  that transports for hire or compensation persons, commodities,
  goods, wares, or merchandise.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
