A BILL TO BE ENTITLED
 
AN ACT
  relating to the compensation and per diem of the commissioners of
  Brazoria Drainage District Number Four.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 9, Chapter 991, Acts of the 74th
  Legislature, Regular Session, 1995, is amended to read as follows:
         Sec. 9.  COMPENSATION AND PER DIEM OF COMMISSIONERS. (a)  In
  this section, "performing the duties of a commissioner" means
  acting in substantive performance of the management or business of
  the district and includes participation in:
               (1)  board and committee meetings and other activities
  involving the substantive deliberation of district business; and
               (2)  pertinent educational programs.
         (b)  Notwithstanding provisions found elsewhere in this Act,
  the salary of a commissioner shall be set at $30 per day or a greater
  amount not to exceed $100 per day if the greater amount is approved
  by a majority vote of the board. It is further provided that a
  commissioner shall receive a per diem of $10 or a greater amount not
  to exceed $50 per day if the greater amount is approved by a
  majority vote of the board.  The salary and per diem are payable for
  each day the commissioner actually spends performing the duties of
  a commissioner.
         (c) [(b)]  Section 49.060 [56.067], Water Code, applies
  [does not apply] to the board to the extent that the provisions of
  that section do not conflict with Subsection (b) of this section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
