A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Harris County Improvement District |
|
|
No. 6 to impose an impact fee or assessment on certain service |
|
|
providers. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 3843.207, Special District Local Laws |
|
|
Code, is amended to read as follows: |
|
|
Sec. 3843.207. PROPERTY OF CERTAIN UTILITIES OR SERVICE |
|
|
PROVIDERS EXEMPT FROM ASSESSMENT AND IMPACT FEES. (a) The |
|
|
district may not impose an impact fee or assessment on the property, |
|
|
including equipment or facilities, of: |
|
|
(1) an electric utility as defined by Section 31.002, |
|
|
Utilities Code; |
|
|
(2) a gas utility as defined by Section 101.003 or |
|
|
121.001, Utilities Code; |
|
|
(3) a telecommunications provider as defined by |
|
|
Section 51.002, Utilities Code; [or] |
|
|
(4) a cable operator as defined by 47 U.S.C. Section |
|
|
522, as amended; or |
|
|
(5) a public radio station. |
|
|
(b) In this section, "public radio station" means a business |
|
|
or enterprise that provides radio broadcasting services to the |
|
|
public and receives a majority of its funding through donations of |
|
|
money from listeners. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
