A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the date of an election to confirm the creation of the |
|
|
Lavaca County Groundwater Conservation District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 8822.023(d), Special District Local Laws |
|
|
Code, is amended to read as follows: |
|
|
(d) If a majority of the votes cast at the election are not |
|
|
in favor of creation of the district, the elected directors shall |
|
|
take office as temporary directors and may hold a subsequent |
|
|
confirmation election on any [the] uniform election date in [May] |
|
|
2010 or 2012. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
