A BILL TO BE ENTITLED
 
AN ACT
  relating to the election of the members of the Board of Port
  Commissioners of the Port of Port Arthur Navigation District of
  Jefferson County.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 9, Chapter 197, Acts of the 58th
  Legislature, Regular Session, 1963, is amended by amending
  Subsections (a), (c), and (d) and adding Subsections (e) and (f) to
  read as follows:
         (a)  The District shall hold an election in the District to
  elect the appropriate number of commissioners on the uniform
  election date in [first Saturday of] May in each odd-numbered year
  [at which time there shall be elected five (5) Port Commissioners].
         (c)  Except as provided by Subsection (f) [(d)] of this
  section, the commissioners serve staggered six-year [four-year]
  terms.
         (d)  Four commissioners are elected from single-member
  districts and one commissioner is elected at large [At the
  commissioner's election held in 1991, five commissioners shall be
  elected. Those elected shall draw lots to determine which two
  commissioners will serve two-year terms and which three
  commissioners will serve four-year terms. At the election held in
  1993, two commissioners shall be elected. Those commissioners and
  commissioners elected at subsequent elections serve four-year
  terms].
         (e)  Before November 30, 2010, the board of commissioners of
  the Port of Port Arthur Navigation District of Jefferson County,
  Texas, shall create four single-member precincts for the election
  of commissioners and establish the boundaries of each single-member
  precinct and the position that will serve each precinct. The
  precincts are subject to the approval of any state or federal agency
  that regulates an election.
         (f)  The commissioners shall determine the date that the term
  for each of the four single-member precincts and the at-large
  position expires by drawing lots for 2011, 2013, and 2015.  At the
  2011 election, two commissioners shall be elected to serve terms of
  six years and one commissioner shall be elected to serve a term of
  four years.  At the 2013 election, two commissioners shall be
  elected to serve terms of six years.  At the election held in 2015,
  one commissioner shall be elected to serve a term of six years.
         SECTION 2.  A commissioner on the effective date of this Act
  may continue in office until a successor is elected and qualified.
         SECTION 3.  (a)  The legal notice of the intention to
  introduce this Act, setting forth the general substance of this
  Act, has been published as provided by law, and the notice and a
  copy of this Act have been furnished to all persons, agencies,
  officials, or entities to which they are required to be furnished
  under Section 59, Article XVI, Texas Constitution, and Chapter 313,
  Government Code.
         (b)  The governor, one of the required recipients, has
  submitted the notice and Act to the Texas Commission on
  Environmental Quality.
         (c)  The Texas Commission on Environmental Quality has filed
  its recommendations relating to this Act with the governor, the
  lieutenant governor, and the speaker of the house of
  representatives within the required time.
         (d)  All requirements of the constitution and laws of this
  state and the rules and procedures of the legislature with respect
  to the notice, introduction, and passage of this Act are fulfilled
  and accomplished.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
