CONCURRENT RESOLUTION
         WHEREAS, Katherine Riley alleges that:
               (1)  on March 30, 2008, while Katherine Riley was
  walking eastward toward the Capitol Visitors Center on the north
  sidewalk of 11th Street between Congress Avenue and Brazos Street
  in Austin, Texas, she was struck by a branch that fell from a tree
  located on the Texas State Capitol grounds;
               (2)  as a result of being struck by the branch, Ms.
  Riley has incurred significant medical expenses totaling more than
  $85,000 for treatment of her injury and rehabilitation; and
               (3)  Ms. Riley has been unsuccessful in seeking
  compensation from the State of Texas for her injury and medical
  expenses; now, therefore, be it
         RESOLVED by the Legislature of the State of Texas, That
  Katherine Riley is granted permission to sue the State of Texas and
  State Preservation Board subject to Chapter 107, Civil Practice and
  Remedies Code; and, be it further
         RESOLVED, That the executive director of the State
  Preservation Board and the attorney general be served process as
  provided by Section 107.002(a)(3), Civil Practice and Remedies
  Code.
