CONCURRENT RESOLUTION
|
|
WHEREAS, Katherine Riley alleges that: |
|
(1) on March 30, 2008, while Katherine Riley was |
|
walking eastward toward the Capitol Visitors Center on the north |
|
sidewalk of 11th Street between Congress Avenue and Brazos Street |
|
in Austin, Texas, she was struck by a branch that fell from a tree |
|
located on the Texas State Capitol grounds; |
|
(2) as a result of being struck by the branch, Ms. |
|
Riley has incurred significant medical expenses totaling more than |
|
$85,000 for treatment of her injury and rehabilitation; and |
|
(3) Ms. Riley has been unsuccessful in seeking |
|
compensation from the State of Texas for her injury and medical |
|
expenses; now, therefore, be it |
|
RESOLVED by the Legislature of the State of Texas, That |
|
Katherine Riley is granted permission to sue the State of Texas and |
|
State Preservation Board subject to Chapter 107, Civil Practice and |
|
Remedies Code; and, be it further |
|
RESOLVED, That the executive director of the State |
|
Preservation Board and the attorney general be served process as |
|
provided by Section 107.002(a)(3), Civil Practice and Remedies |
|
Code. |
