R E S O L U T I O N
 
         BE IT RESOLVED by the House of Representatives of the State of
  Texas, 81st Legislature, Regular Session, 2009, That House Rule 13,
  Section 9(a), be suspended in part as provided by House Rule 13,
  Section 9(f), to enable the conference committee appointed to
  resolve the differences on Senate Bill 2513 (name and confirmation
  of, and certain fees imposed by, the McLennan County Groundwater
  Conservation District and the authority to create certain adjacent
  groundwater conservation districts) to consider and take action on
  the following matter:
         House Rule 13, Sections 9(a)(3) and (4), are suspended to
  permit the committee to add the following:
               SECTION 3.  Section 8821.002, Special District Local
  Laws Code, is amended to read as follows:
         Sec. 8821.002.  NATURE OF DISTRICT. The district is a
  groundwater conservation district in McLennan County created under
  and essential to accomplish the purposes of Section 59, Article
  XVI, Texas Constitution.  The district is located in a priority
  groundwater management area designated by the Texas Commission on
  Environmental Quality pursuant to Section 35.008, Water Code.
         Explanation:  The addition of the SECTION to the bill is
  necessary to recognize that the Southern Trinity Groundwater
  Conservation District is in a priority groundwater management area
  designated by the Texas Commission on Environmental Quality.
         House Rule 13, Sections 9(a)(3) and (4), are suspended to
  permit the committee to add the following:
         SECTION 8.  Notwithstanding Sections 35.012 and 36.0151,
  Water Code, the Texas Commission on Environmental Quality shall
  not, before September 1, 2011, create a groundwater conservation
  district:
               (1)  in the priority groundwater management area in
  which the Southern Trinity Groundwater Conservation District is
  located; or
               (2)  in a priority groundwater management area that is
  adjacent to the priority groundwater management area in which the
  Southern Trinity Groundwater Conservation District is located.
         Explanation: The addition of the SECTION to the bill is
  necessary to delay until September 1, 2011, the requirement for the
  Texas Commission on Environmental Quality to create a groundwater
  conservation district in the same priority groundwater management
  area in which the Southern Trinity Groundwater Conservation
  District is located or in a priority groundwater management area
  that is adjacent to that district.
