A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the definition of a police vehicle for the purposes of |
|
|
certain traffic laws. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 541.201(13-a), Transportation Code, is |
|
|
amended to read as follows: |
|
|
(13-a) "Police vehicle" means a vehicle [of a
|
|
|
governmental entity] primarily used by a peace officer, as defined |
|
|
by Article 2.12, Code of Criminal Procedure, for law enforcement |
|
|
purposes that: |
|
|
(A) is owned or leased by a governmental entity; |
|
|
or |
|
|
(B) is: |
|
|
(i) a private vehicle owned or leased by the |
|
|
peace officer; and |
|
|
(ii) approved for use for law enforcement |
|
|
purposes by the head of the law enforcement agency that employs the |
|
|
peace officer, or by that person's designee. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
