A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the prohibition on certification of sex offenders as |
|
emergency medical services personnel. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter C, Chapter 773, Health and Safety |
|
Code, is amended by adding Section 773.0415 to read as follows: |
|
Sec. 773.0415. CERTIFICATION OF SEX OFFENDER PROHIBITED. A |
|
person who has been convicted of or placed on deferred adjudication |
|
for an offense for which the person is subject to registration under |
|
Chapter 62, Code of Criminal Procedure, may not be certified as any |
|
type of emergency medical services personnel under this chapter. |
|
SECTION 2. (a) The change in law made by this Act applies |
|
only to the renewal of an emergency medical technician certificate |
|
that expires on or after the effective date of this Act. A |
|
certificate that expires before the effective date of this Act is |
|
governed by the law in effect on the date the certificate was |
|
issued, and the former law is continued in effect for that purpose. |
|
(b) The change in law made by this Act applies to an |
|
application for an emergency medical technician certificate that is |
|
pending on the effective date of this Act or that is filed on or |
|
after that date. |
|
SECTION 3. This Act takes effect September 1, 2009. |
