A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to an exception to the purchase of a refrigerant or |
|
|
equipment containing a refrigerant. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 1302.453(b), Occupations Code, is |
|
|
amended to read as follows: |
|
|
(b) It is an exception to the application of this section |
|
|
with respect to a purchase of a refrigerant or equipment containing |
|
|
a refrigerant in this state in violation of Section 1302.356(1) |
|
|
[1302.356] that: |
|
|
(1) the refrigerant or equipment is purchased for use |
|
|
in a commercial or residential air conditioning system that |
|
|
requires 15 pounds or less of refrigerant; or |
|
|
(2) the refrigerant or equipment is purchased for use |
|
|
only in a motor vehicle and that use is authorized by the United |
|
|
States Environmental Protection Agency. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
covered by the law in effect when the offense was committed, and the |
|
|
former law is continued in effect for that purpose. For purposes of |
|
|
this section, an offense was committed before the effective date of |
|
|
this Act if any element of the offense occurred before that date. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
