A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the penalty for failure to yield the right-of-way. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 545.153, Transportation Code, is amended |
|
|
by adding Subsection (e) to read as follows: |
|
|
(e) If it is shown on the trial of an offense under this |
|
|
section that as a result of the commission of the offense an |
|
|
accident causing injury to or the death of a pedestrian occurred: |
|
|
(1) the minimum fine applicable to the offense is |
|
|
twice the minimum fine that would otherwise be applicable to the |
|
|
offense; and |
|
|
(2) the maximum fine applicable to the offense is |
|
|
twice the maximum fine that would otherwise be applicable to the |
|
|
offense. |
|
|
SECTION 2. (a) The change in law made by this Act applies |
|
|
only to an offense committed on or after the effective date of this |
|
|
Act. For purposes of this section, an offense is committed before |
|
|
the effective date of this Act if any element of the offense occurs |
|
|
before that date. |
|
|
(b) An offense committed before the effective date of this |
|
|
Act is covered by the law in effect when the offense was committed, |
|
|
and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
