|  | A BILL TO BE ENTITLED | 
|  | AN ACT | 
|  | relating to the use of net metering by certain electric utilities. | 
|  | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | 
|  | SECTION 1.  Section 39.107, Utilities Code, is amended by | 
|  | amending Subsection (i), as added by Chapter 939 (H.B. 3693), Acts | 
|  | of the 80th Legislature, Regular Session, 2007, and adding | 
|  | Subsection (k) to read as follows: | 
|  | (i)  Subject to the restrictions in Subsection (h), it is the | 
|  | intent of the legislature that [ net metering and] advanced meter | 
|  | information networks be deployed as rapidly as possible to allow | 
|  | customers to better manage energy use and control costs, and to | 
|  | facilitate demand response initiatives. | 
|  | (k)  Notwithstanding any other law, the commission shall | 
|  | adopt rules and standards under which a retail electric provider, | 
|  | electric cooperative, municipally owned utility, or transmission | 
|  | and distribution utility shall offer net metering service as | 
|  | defined by the federal Public Utility Regulatory Policies Act of | 
|  | 1978 (16 U.S.C. Section 2621(d)(11)) to all residential customers | 
|  | as soon as practicable but not later than January 1, 2010. | 
|  | SECTION 2.  This Act takes effect immediately if it receives | 
|  | a vote of two-thirds of all the members elected to each house, as | 
|  | provided by Section 39, Article III, Texas Constitution.  If this | 
|  | Act does not receive the vote necessary for immediate effect, this | 
|  | Act takes effect September 1, 2009. |
