A BILL TO BE ENTITLED
 
AN ACT
  relating to the use of net metering by certain electric utilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 39.107, Utilities Code, is amended by
  amending Subsection (i), as added by Chapter 939 (H.B. 3693), Acts
  of the 80th Legislature, Regular Session, 2007, and adding
  Subsection (k) to read as follows:
         (i)  Subject to the restrictions in Subsection (h), it is the
  intent of the legislature that [net metering and] advanced meter
  information networks be deployed as rapidly as possible to allow
  customers to better manage energy use and control costs, and to
  facilitate demand response initiatives.
         (k)  Notwithstanding any other law, the commission shall
  adopt rules and standards under which a retail electric provider,
  electric cooperative, municipally owned utility, or transmission
  and distribution utility shall offer net metering service as
  defined by the federal Public Utility Regulatory Policies Act of
  1978 (16 U.S.C. Section 2621(d)(11)) to all residential customers
  as soon as practicable but not later than January 1, 2010.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
