A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the use of net metering by certain electric utilities. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 39.107, Utilities Code, is amended by |
|
amending Subsection (i), as added by Chapter 939 (H.B. 3693), Acts |
|
of the 80th Legislature, Regular Session, 2007, and adding |
|
Subsection (k) to read as follows: |
|
(i) Subject to the restrictions in Subsection (h), it is the |
|
intent of the legislature that [net metering and] advanced meter |
|
information networks be deployed as rapidly as possible to allow |
|
customers to better manage energy use and control costs, and to |
|
facilitate demand response initiatives. |
|
(k) Notwithstanding any other law, the commission shall |
|
adopt rules and standards under which a retail electric provider, |
|
electric cooperative, municipally owned utility, or transmission |
|
and distribution utility shall offer net metering service as |
|
defined by the federal Public Utility Regulatory Policies Act of |
|
1978 (16 U.S.C. Section 2621(d)(11)) to all residential customers |
|
as soon as practicable but not later than January 1, 2010. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
