A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the capability of the Public Education Information |
|
Management System (PEIMS) to provide information regarding public |
|
school students placed in foster care. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 42.006, Education Code, is amended by |
|
adding Subsection (c-1) to read as follows: |
|
(c-1) The commissioner's rules must ensure that the Public |
|
Education Information Management System contains all information |
|
necessary to permit the agency to track the performance of students |
|
placed in foster care. As necessary to achieve that capability, the |
|
Department of Family and Protective Services shall provide school |
|
districts or the agency, as appropriate, with information regarding |
|
the identity of students placed in foster care. Information |
|
provided by the Department of Family and Protective Services under |
|
this subsection or contained in the Public Education Information |
|
Management System regarding the specific identity of students in |
|
foster care is confidential, and the privacy of those students must |
|
be protected in accordance with rules adopted by the commissioner. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
