A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to increasing public awareness of the benefits of native |
|
plant species. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subtitle C, Title 5, Business & Commerce Code, as |
|
effective April 1, 2009, is amended by adding Chapter 106 to read as |
|
follows: |
|
CHAPTER 106. INCREASING AWARENESS OF NATIVE PLANT SPECIES |
|
Sec. 106.101. DEFINITION. In this chapter, "plant nursery" |
|
means a business that sells plants to the public. The term includes |
|
a landscaping service. |
|
Sec. 106.102. REQUIREMENT. A plant nursery shall make |
|
available to its customers a printed copy of the brochure developed |
|
by the Texas Parks and Wildlife Department under Section 12.0105, |
|
Parks and Wildlife Code, that describes the benefits of native |
|
plant species and the problems associated with invasive plant |
|
species. The plant nursery may satisfy the requirement of this |
|
section by posting in a conspicuous location accessible to the |
|
nursery's customers a sign that contains the department's Internet |
|
website address for the brochure. |
|
SECTION 2. Subchapter A, Chapter 12, Parks and Wildlife |
|
Code, is amended by adding Section 12.0105 to read as follows: |
|
Sec. 12.0105. The department may develop and maintain on |
|
the department's Internet website a brochure describing the |
|
benefits of native plant species and the problems associated with |
|
invasive plant species. |
|
SECTION 3. This Act takes effect September 1, 2009. |
