A BILL TO BE ENTITLED
 
AN ACT
  relating to increasing public awareness of the benefits of native
  plant species.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle C, Title 5, Business & Commerce Code, as
  effective April 1, 2009, is amended by adding Chapter 106 to read as
  follows:
  CHAPTER 106. INCREASING AWARENESS OF NATIVE PLANT SPECIES
         Sec. 106.101.  DEFINITION. In this chapter, "plant nursery"
  means a business that sells plants to the public.  The term includes
  a landscaping service.
         Sec. 106.102.  REQUIREMENT. A plant nursery shall make
  available to its customers a printed copy of the brochure developed
  by the Texas Parks and Wildlife Department under Section 12.0105,
  Parks and Wildlife Code, that describes the benefits of native
  plant species and the problems associated with invasive plant
  species.  The plant nursery may satisfy the requirement of this
  section by posting in a conspicuous location accessible to the
  nursery's customers a sign that contains the department's Internet
  website address for the brochure.
         SECTION 2.  Subchapter A, Chapter 12, Parks and Wildlife
  Code, is amended by adding Section 12.0105 to read as follows:
         Sec. 12.0105.  The department may develop and maintain on
  the department's Internet website a brochure describing the
  benefits of native plant species and the problems associated with
  invasive plant species.
         SECTION 3.  This Act takes effect September 1, 2009.
