A BILL TO BE ENTITLED
 
AN ACT
  relating to the holidays for members of fire and police departments
  in certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 142.0013, Local Government Code, is
  amended by adding Subsection (d) to read as follows:
         (d)  A fire fighter or police officer is entitled to a paid
  day off from working on September 11 of each year if:
               (1)  the fire fighter or police officer:
                     (A)  agrees or is required to work on a holiday
  during the same fiscal year and chooses to take that holiday on
  September 11; or
                     (B)  chooses to use a vacation day, a day in lieu
  of a vacation day or holiday, or accumulated compensatory leave to
  take a paid day off on September 11; and
               (2)  the fire fighter's or police officer's supervisor
  does not require the fire fighter or police officer to work that day
  to maintain minimum staffing necessary for public safety.
         SECTION 2.  This Act takes effect September 1, 2009.
