A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the requirement by a municipality of a license or permit |
|
|
to occupy or lease a dwelling unit. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 214, Local Government |
|
|
Code, is amended by adding Section 214.907 to read as follows: |
|
|
Sec. 214.907. LIMITATION ON MUNICIPAL REQUIREMENTS OF |
|
|
LICENSE OR PERMIT TO OCCUPY DWELLING UNIT. A municipality may not |
|
|
require a tenant to acquire a license or permit issued by the |
|
|
municipality as a condition for occupying or leasing an individual |
|
|
dwelling unit in a single-family, duplex, or multifamily structure. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
