A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the terms of the members of the Court Reporters |
|
|
Certification Board. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 52.011(f), Government Code, is amended |
|
|
to read as follows: |
|
|
(f) Board members serve staggered six-year terms of office, |
|
|
with the terms of two or three members expiring on December 31 of |
|
|
each year. |
|
|
SECTION 2. (a) To comply with Section 52.011(f), |
|
|
Government Code, as amended by this Act, the Texas Supreme Court, as |
|
|
soon as possible after the effective date of this Act, shall |
|
|
prescribe a method for determining the dates on which the terms of |
|
|
the members of the Court Reporters Certification Board serving, and |
|
|
of the offices that are vacant, on the effective date of this Act |
|
|
expire. By using the method prescribed by the Texas Supreme Court: |
|
|
(1) a combination of two members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2010; |
|
|
(2) a combination of two members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2011; |
|
|
(3) a combination of two members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2012; |
|
|
(4) a combination of two members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2013; |
|
|
(5) a combination of two members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2014; and |
|
|
(6) a combination of three members serving, or offices |
|
|
vacant, on the effective date of this Act must be selected for a |
|
|
term expiration date of December 31, 2015. |
|
|
(b) The method prescribed by the Texas Supreme Court as |
|
|
required by Subsection (a) of this section may be a drawing of lots. |
|
|
(c) For purposes of Section 52.011(g), Government Code, the |
|
|
term being served by a member of the Court Reporters Certification |
|
|
Board on the effective date of this Act that expires in accordance |
|
|
with Subsection (a) of this section is considered a single term. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
