A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to exemptions from certain mandated benefit requirements |
|
|
in supplemental or limited coverage health benefit plans. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subtitle G, Title 8, Insurance Code, is amended |
|
|
by adding Chapter 1509 to read as follows: |
|
|
CHAPTER 1509. SUPPLEMENTAL OR LIMITED COVERAGE PLANS |
|
|
Sec. 1509.001. DEFINITION. In this chapter, "supplemental |
|
|
or limited coverage plan" means a dental plan, a vision plan, an |
|
|
accident-only plan, a limited benefits plan, and other supplemental |
|
|
insurance policies as designated by the commissioner. |
|
|
Sec. 1509.002. EXEMPTION. A supplemental or limited |
|
|
coverage plan is not required to provide coverage for a |
|
|
state-mandated benefit, as that term is used by Chapter 1507. |
|
|
SECTION 2. This Act applies only to an insurance policy or |
|
|
contract or evidence of coverage that is delivered, issued for |
|
|
delivery, or renewed on or after January 1, 2010. An insurance |
|
|
policy or contract or evidence of coverage delivered, issued for |
|
|
delivery, or renewed before January 1, 2010, is governed by the law |
|
|
as it existed immediately before the effective date of this Act, and |
|
|
that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
