A BILL TO BE ENTITLED
 
AN ACT
  relating to child support arrearages and a counterclaim or offset
  based on certain disability payments.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 157.262(f), Family Code, is amended to
  read as follows:
         (f)  A lump sum dependent's disability payment made by the
  Social Security Administration or the Veterans Administration to
  the obligee for the benefit of the child as a result of the
  obligor's disability may be used by the obligor as a counterclaim or
  offset to a [The] money judgment for arrearages [rendered by the
  court may be subject to a counterclaim or offset as provided by this
  subchapter].
         SECTION 2.  The change in law made by this Act applies to a
  motion for enforcement of child support that is pending in a trial
  court on or filed on or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2009.
