A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to child support arrearages and a counterclaim or offset |
|
|
based on certain disability payments. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 157.262(f), Family Code, is amended to |
|
|
read as follows: |
|
|
(f) A lump sum dependent's disability payment made by the |
|
|
Social Security Administration or the Veterans Administration to |
|
|
the obligee for the benefit of the child as a result of the |
|
|
obligor's disability may be used by the obligor as a counterclaim or |
|
|
offset to a [The] money judgment for arrearages [rendered by the
|
|
|
court may be subject to a counterclaim or offset as provided by this
|
|
|
subchapter]. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
motion for enforcement of child support that is pending in a trial |
|
|
court on or filed on or after the effective date of this Act. |
|
|
SECTION 3. This Act takes effect September 1, 2009. |
