A BILL TO BE ENTITLED
 
AN ACT
  relating to in-casket identification of a deceased person.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle B, Title 8, Health and Safety Code, is
  amended by adding Chapter 695 to read as follows:
  CHAPTER 695.  IN-CASKET IDENTIFICATION
         Sec. 695.001.  DEFINITIONS.  In this chapter:
               (1)  "Casket" means a container used to hold the
  remains of a deceased person.
               (2)  "Commission" means the Texas Funeral Service
  Commission.
         Sec. 695.002.  IDENTIFICATION OF DECEASED PERSON.  The
  commission shall ensure a casket contains identification of the
  deceased person, including the person's name, date of birth, and
  date of death.
         Sec. 695.003.  RULES.  The commission may adopt rules to
  enforce this chapter.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
