A BILL TO BE ENTITLED
 
AN ACT
  relating to the administration of immunizations and vaccinations by
  therapeutic optometrists.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 351, Occupations Code, is
  amended by adding Section 351.3582 to read as follows:
         Sec. 351.3582.  ADMINISTRATION OF IMMUNIZATIONS AND
  VACCINATIONS. (a) A therapeutic optometrist that satisfies the
  education requirements established by the board under this section
  may administer an immunization or vaccination to a person over the
  age of 14.
         (b)  A therapeutic optometrist may not delegate the
  authority to administer an immunization or vaccination.
         (c)  The board shall establish:
               (1)  minimum education and continuing education
  standards for a therapeutic optometrist who administers an
  immunization or vaccination. The standards must include Centers
  for Disease Control and Prevention training, basic life support
  training, and hands-on training in techniques for administering
  immunizations and vaccinations; and
               (2)  reporting requirements designed to notify a
  patient's primary care physician of any immunization or vaccination
  administered by a therapeutic optometrist.
         SECTION 2.  This Act takes effect September 1, 2009.
