A BILL TO BE ENTITLED
 
AN ACT
  relating to the Hardeman County Hospital District.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1038.051(d), Special District Local Laws
  Code, as effective April 1, 2009, is amended to read as follows:
         (d)  An election shall be held on the uniform election date
  in May of each year to elect the appropriate number of directors
  [Section 41.001, Election Code, applies to an election held under
  this section].
         SECTION 2.  Section 1038.052, Special District Local Laws
  Code, as effective April 1, 2009, is amended to read as follows:
         Sec. 1038.052.  NOTICE OF ELECTION.  The [At least 30 days
  before the date of an election of directors, the] board shall
  publish notice of the election [one time] in a newspaper or
  newspapers that individually or collectively have general
  circulation in the district in accordance with Section 4.003,
  Election Code.
         SECTION 3.  Section 1038.062, Special District Local Laws
  Code, as effective April 1, 2009, is amended by adding Subsections
  (e) and (f) to read as follows:
         (e)  The board may employ physicians and other health care
  providers as the board considers necessary for the efficient
  operation of the district.
         (f)  This section may not be construed as authorizing the
  board to supervise or control the practice of medicine, as
  prohibited by Subtitle B, Title 3, Occupations Code.
         SECTION 4.  Section 1038.301, Special District Local Laws
  Code, as effective April 1, 2009, is amended by adding Subsection
  (e) to read as follows:
         (e)  Section 41.001(a), Election Code, does not apply to an
  election ordered under this section.
         SECTION 5.  Section 1038.007, Special District Local Laws
  Code, as effective April 1, 2009, is repealed.
         SECTION 6.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
