A BILL TO BE ENTITLED
 
AN ACT
  relating to certain orders by the commissioner of insurance during
  a state of disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 542, Insurance Code, is
  amended by adding Section 542.062 to read as follows:
         Sec. 542.062.  COMMISSIONER POWERS DURING DISASTER.  On
  declaration of a state of disaster under Section 418.014,
  Government Code, the commissioner may issue an order to suspend,
  for a period not longer than the duration of the declaration,
  enforcement of the regulation of on-premises outdoor signs by
  municipalities under Subchapter Z, Chapter 216, Local Government
  Code, for municipalities located in counties within and adjacent to
  the counties in the disaster area specified by the declaration, if
  the commissioner finds that such a suspension would facilitate the
  filing and processing of claims by persons affected by the
  disaster.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
