A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to certain orders by the commissioner of insurance during |
|
a state of disaster. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter B, Chapter 542, Insurance Code, is |
|
amended by adding Section 542.062 to read as follows: |
|
Sec. 542.062. COMMISSIONER POWERS DURING DISASTER. On |
|
declaration of a state of disaster under Section 418.014, |
|
Government Code, the commissioner may issue an order to suspend, |
|
for a period not longer than the duration of the declaration, |
|
enforcement of the regulation of on-premises outdoor signs by |
|
municipalities under Subchapter Z, Chapter 216, Local Government |
|
Code, for municipalities located in counties within and adjacent to |
|
the counties in the disaster area specified by the declaration, if |
|
the commissioner finds that such a suspension would facilitate the |
|
filing and processing of claims by persons affected by the |
|
disaster. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
