A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to performance ratings assigned to certain |
|
|
open-enrollment charter schools under the public school |
|
|
accountability system. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.072, Education Code, is amended by |
|
|
adding Subsection (a-1) to read as follows: |
|
|
(a-1) Notwithstanding Subsection (a) or (c) or Section |
|
|
12.104(b)(2)(L), an open-enrollment charter school that provides |
|
|
educational services only to students confined by court order in a |
|
|
residential program or facility operated by a juvenile board: |
|
|
(1) is not subject to assignment of a performance |
|
|
rating under Subsection (a); and |
|
|
(2) shall be considered under the accountability |
|
|
system in the same manner as other entities that are not rated under |
|
|
that system. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
