A BILL TO BE ENTITLED
 
AN ACT
  relating to promoting safety in public schools.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter J, Chapter 21, Education Code, is
  amended by adding Section 21.4512 to read as follows:
         Sec. 21.4512.  SAFETY TRAINING REQUIRED FOR SCHOOL
  ADMINISTRATORS. A superintendent or principal employed by a school
  district must attend the safety training program provided under
  Section 37.205 on or before the first anniversary of the date of the
  person's first day of employment with the district. The
  requirement to attend a safety training program under this section
  applies only to a person's initial employment by any school
  district in this state.
         SECTION 2.  Section 37.081, Education Code, is amended by
  adding Subsections (i) and (j) to read as follows:
         (i)  A school district peace officer must attend the safety
  training program provided under Section 37.205 on or before the
  first anniversary of the date of the officer's first day of
  employment with the district. The requirement to attend a safety
  training program under this section applies only to a peace
  officer's initial employment by any school district in this state.
         (j)  The board of trustees of a school district that
  commissions peace officers shall provide in written district policy
  and post on a district Internet website:
               (1)  a statement describing the employment
  relationship between the district and the peace officers; and
               (2)  a brief description of district police department
  responsibilities and procedures.
         SECTION 3.  Subchapter C, Chapter 37, Education Code, is
  amended by adding Section 37.087 to read as follows:
         Sec. 37.087.  REPORT RELATING TO ISSUANCE OF CITATIONS. (a)
  The chief of police of a school district police department or
  another person designated by the board of trustees of the district
  shall annually report to the board of trustees each action taken by
  a district peace officer concerning a district student's violation
  of a penal law of this state or a local ordinance, disaggregated by
  the peace officer action taken, the student conduct involved, and
  the age, grade level, race, ethnicity, gender, and special
  education status of the student.
         (b)  The board of trustees of the school district shall:
               (1)  report the information provided under Subsection
  (a) at the first regularly scheduled board meeting held after the
  information is provided under Subsection (a); and
               (2)  post the information provided on a district
  Internet website.
         SECTION 4.  Section 37.205, Education Code, is amended to
  read as follows:
         Sec. 37.205.  SAFETY TRAINING PROGRAMS. The center shall
  conduct for school districts a safety training program that
  includes:
               (1)  development of a positive school environment and
  proactive safety and discipline measures designed to address local
  concerns;
               (2)  school safety courses and positive proactive
  discipline training for law enforcement officials, with a focus on
  school district police officers and school resource officers;
               (3)  discussion of school safety issues with parents
  and community members; and
               (4)  assistance in developing a multihazard emergency
  operations plan for adoption under Section 37.108.
         SECTION 5.  (a) Notwithstanding Section 21.4512, Education
  Code, as added by this Act, a superintendent or principal employed
  by a school district on the effective date of this Act must attend
  the safety training program provided under Section 37.205,
  Education Code, as amended by this Act, on or before August 31,
  2010.
         (b)  Notwithstanding Section 37.081(i), Education Code, as
  added by this Act, a peace officer employed by a school district on
  the effective date of this Act must attend the safety training
  program provided under Section 37.205, Education Code, as amended
  by this Act, on or before August 31, 2010.
         SECTION 6.  Sections 37.081(j) and 37.087, Education Code,
  as added by this Act, and Section 37.205, Education Code, as amended
  by this Act, apply beginning with the 2009-2010 school year.
         SECTION 7.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
