A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a public hearing held by the Texas Transportation |
|
|
Commission in connection with certain highway projects. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Sections 203.021(b) and (c), Transportation |
|
|
Code, are amended to read as follows: |
|
|
(b) Notice of the hearing shall be by publication in the |
|
|
locality. The hearing shall be held not less than five [three] or |
|
|
more than 20 [10] days after the date of publication. |
|
|
(c) At least seven days before the date of the public |
|
|
hearing, the department shall: |
|
|
(1) file with the governing body of the county or |
|
|
municipality the design and schematic layout of the project; and |
|
|
(2) post the design and schematic layout of the |
|
|
project on the department's Internet website. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
