A BILL TO BE ENTITLED
 
AN ACT
 
  relating to privately funded memorials honoring certain peace
  officers killed in the line of duty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter K, Chapter 201, Transportation Code,
  is amended by adding Section 201.910 to read as follows:
         Sec. 201.910.  MEMORIAL MARKERS FOR CERTAIN PEACE OFFICERS
  KILLED IN LINE OF DUTY.  (a)  The commission by rule shall authorize
  memorial markers honoring peace officers killed in the line of duty
  who are not Department of Public Safety troopers.  The program
  established under this section shall be identical to the
  commission's existing program for memorial markers for honoring
  Department of Public Safety troopers.
         (b)  As used in this section, "peace officer" means a person
  who was:
               (1)  a law enforcement officer or peace officer for
  this state or a political subdivision of this state under Article
  2.12, Code of Criminal Procedure, or other law; or
               (2)  a federal law enforcement officer or special agent
  performing duties in this state, including those officers under
  Article 2.122, Code of Criminal Procedure.
         SECTION 2.  This Act takes effect September 1, 2009.
