A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the allocation of certain constitutionally dedicated |
|
funds to the Lamar Institute of Technology. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 62.021, Education Code, is amended by |
|
adding Subsection (a-1) to read as follows: |
|
(a-1) Notwithstanding Subsection (a), for each year |
|
remaining in the 10-year allocation period established under |
|
Section 17(d), Article VII, Texas Constitution, that ends in 2015, |
|
the comptroller shall distribute to the Lamar Institute of |
|
Technology in accordance with the allocation formula described by |
|
Subsection (a) a portion of the total annual appropriation under |
|
Section 17(a), Article VII, Texas Constitution, otherwise |
|
allocated under Subsection (a). The comptroller shall adjust the |
|
distributions made to other eligible institutions under the |
|
equitable formula as necessary to reflect the inclusion of the |
|
Lamar Institute of Technology in the agencies and institutions |
|
participating in the allocation of the annual appropriation under |
|
Section 17(a), Article VII, Texas Constitution. This subsection |
|
expires January 1, 2016. |

SECTION 2. This Act takes effect January 1, 2010, but only |
|
if the constitutional amendment proposed by the 81st Legislature, |
|
Regular Session, 2009, to allow the Lamar Institute of Technology |
|
to participate in the allocation of certain constitutionally |
|
dedicated funds for capital improvements at agencies and |
|
institutions of higher education is approved by the voters. If that |
|
constitutional amendment is not approved by the voters, this Act |
|
does not take effect. |
