A BILL TO BE ENTITLED
 
AN ACT
  relating to license renewal requirements for licensed professional
  counselors.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 503.354, Occupations Code, is amended by
  adding Subsection (d-1) and amending Subsection (e) to read as
  follows:
         (d-1)  If a person's license has been expired for more than
  one year but less than four years, and if the person has not been the
  subject of any disciplinary action taken by or pending before the
  board on or after the date the license expired, the person may renew
  the license by:
               (1)  fulfilling continuing education requirements as
  set by the board; and
               (2)  paying the renewal fees for each year in which the
  license has been expired.
         (e)  A person whose license has been expired for four years
  [one year] or more may not renew the license. The person may obtain
  a new license by complying with the requirements and procedures for
  obtaining an original license.
         SECTION 2.  Section 503.354, Occupations Code, as amended by
  this Act, applies only to a licensed professional counselor license
  renewed on or after the effective date of this Act. A license
  renewed before the effective date of this Act is governed by the law
  in effect immediately before that date, and the former law is
  continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2009.
