A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to license renewal requirements for licensed professional |
|
counselors. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 503.354, Occupations Code, is amended by |
|
adding Subsection (d-1) and amending Subsection (e) to read as |
|
follows: |
|
(d-1) If a person's license has been expired for more than |
|
one year but less than four years, and if the person has not been the |
|
subject of any disciplinary action taken by or pending before the |
|
board on or after the date the license expired, the person may renew |
|
the license by: |
|
(1) fulfilling continuing education requirements as |
|
set by the board; and |
|
(2) paying the renewal fees for each year in which the |
|
license has been expired. |
|
(e) A person whose license has been expired for four years |
|
[one year] or more may not renew the license. The person may obtain |
|
a new license by complying with the requirements and procedures for |
|
obtaining an original license. |
|
SECTION 2. Section 503.354, Occupations Code, as amended by |
|
this Act, applies only to a licensed professional counselor license |
|
renewed on or after the effective date of this Act. A license |
|
renewed before the effective date of this Act is governed by the law |
|
in effect immediately before that date, and the former law is |
|
continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2009. |
