A BILL TO BE ENTITLED
 
AN ACT
  Related to parole board rules regarding inmates claiming actual
  innocence.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article 508.0441, Government Code, is amended to
  read as follows:
         (d)  The parole board may not adopt any rule, policy or
  practice that penalizes or denies privileges to a prisoner for
  failing to take responsibility for the crime for which they were
  incarcerated or other offenses for which the prisoner has not been
  finally convicted if that prisoner maintained innocence at trial
  and throughout the post-conviction appellate process, including
  any post-conviction habeas writs.
         (e)  The presiding officer may provide a written plan for the
  administrative review of actions taken by a parole panel by a review
  panel.
         (f)  Board members and parole commissioners shall, at the
  direction of the presiding officer, file activity reports on duties
  performed under this chapter.
         SECTION 2.  This Act takes effect September 1, 2009.
