A BILL TO BE ENTITLED
 
AN ACT
 
  relating to the amount of hazardous duty pay for certain employees
  of the Texas Department of Criminal Justice.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subsection (h), Section 659.305, Government
  Code, is amended to read as follows:
         (h)  The amount of hazardous duty pay for a particular month
  for a full-time state employee [correctional officer] employed by
  the Texas Department of Criminal Justice is [the lesser of:
               [(1)]  $12 for each 12-month period of lifetime service
  credit accrued by the employee[; or
               [(2)  $300].
         SECTION 2.  This Act does not make an appropriation. A
  provision in this Act that creates a new governmental program,
  creates a new entitlement, or imposes a new duty on a governmental
  entity is not mandatory during a fiscal period for which the
  legislature has not made a specific appropriation to implement the
  provision.
         SECTION 3.  This Act takes effect September 1, 2009.
