A BILL TO BE ENTITLED
 
AN ACT
  relating to a student health services fee at component institutions
  of The Texas A&M University System and to authorizing the
  financing, construction, maintenance, and improvement of health
  facilities with the fee at the institutions.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  The heading to Section 54.507, Education Code,
  is amended to read as follows:
         Sec. 54.507.  STUDENT HEALTH [GROUP HOSPITAL AND MEDICAL
  SERVICES FEE [FEES]; TEXAS A&M UNIVERSITY SYSTEM.
         SECTION 2.  Section 54.507, Education Code, is amended by
  amending Subsections (a) and (c) and adding Subsection (a-1) to
  read as follows:
         (a)  The Board of Regents of The Texas A&M University System
  may charge [levy and collect from] each student enrolled at a
  component [any] institution of [higher education which is a part
  of] The Texas A&M University System a student health [compulsory
  group hospital and medical] services fee not to exceed $75 for each
  regular semester and not to exceed $25 for each summer term [of each
  summer session].  The student health [compulsory group hospital and
  medical] services fee may not be charged [levied] unless [the levy
  of] the fee has been approved by a majority vote of those students
  at the affected institution participating in a general student
  election called for that purpose.
         (a-1)  This subsection applies only to Texas A&M University
  in College Station.  Notwithstanding Subsection (a), the Board of
  Regents of The Texas A&M University System may charge each student
  enrolled at an institution to which this subsection applies a
  student health services fee not to exceed $100 for each regular
  semester or $50 for each summer term.  The fee may not be increased
  by more than 10 percent of the total amount of the fee that is in
  effect on January 1, 2009, or as last approved by a student vote
  under this section, if applicable, unless the increase has been
  approved by a majority vote of the students voting in an election
  held for that purpose.
         (c)  A fee charged [levied] under this section at a component
  institution of The Texas A&M University System may be used [only] to
  provide hospital or other medical services to students registered
  at that component institution and for financing, constructing,
  maintaining, and improving new and existing student health
  facilities at that institution.
         SECTION 3.  This Act applies beginning with the 2009 fall
  semester.
         SECTION 4.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
