A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to engineering and design contracts for the Texas |
|
|
Department of Transportation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Amend Section 223.041 of the Transportation Code |
|
|
by adding Subsections (c) and (d) to read as follows: |
|
|
(c) The Department may not contract with a private sector |
|
|
provider whose ratio of licensed professional engineers to value of |
|
|
work performed on a biennual basis exceeds that of the Department. |
|
|
(d) The Department may not contract with a private sector |
|
|
provider whose annual compensation for licensed professional |
|
|
engineers, on average, exceeds the average annual compensation of |
|
|
licensed professional engineers who are employed by the Department. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
