A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the operation in certain counties of an integrated care |
|
management model under the Medicaid managed care program. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 533, Government Code, is |
|
amended by adding Section 533.064 to read as follows: |
|
Sec. 533.064. IMPLEMENTATION OF INTEGRATED CARE MANAGEMENT |
|
MODEL IN CERTAIN COUNTIES. Notwithstanding Section 533.062, the |
|
commission may not contract with an administrative services |
|
organization to perform the coordination of care and other services |
|
and functions of the integrated care management model developed |
|
under Section 533.061, and may not otherwise implement the model, |
|
in the Dallas or Tarrant Medicaid service area, as those areas |
|
existed on January 1, 2009. |
|
SECTION 2. (a) To the extent permitted by law or the terms |
|
of the contract, the Health and Human Services Commission shall |
|
terminate a contract entered into before the effective date of this |
|
Act with an administrative services organization to perform |
|
services and functions described by Section 533.062, Government |
|
Code, in the Dallas or Tarrant Medicaid service area. |
|
(b) On and after the effective date of this Act, the Health |
|
and Human Services Commission may not enter into or renew a contract |
|
with an administrative services organization to perform services |
|
and functions described by Section 533.062, Government Code, in the |
|
Dallas or Tarrant Medicaid service area. |
|
SECTION 3. If before implementing any provision of this Act |
|
a state agency determines that a waiver or authorization from a |
|
federal agency is necessary for implementation of that provision, |
|
the agency affected by the provision shall request the waiver or |
|
authorization and may delay implementing that provision until the |
|
waiver or authorization is granted. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2009. |
