A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to imposing a duty on a sheriff to report certain warrant |
|
|
or capias information to a national database. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 2, Code of Criminal Procedure, is |
|
|
amended by adding Article 2.195 to read as follows: |
|
|
Art. 2.195. DUTY TO REPORT WARRANT OR CAPIAS INFORMATION. |
|
|
Within 30 days of the day the court clerk issues the warrant, the |
|
|
sheriff shall report to the national crime information center each |
|
|
warrant or capias issued for a defendant charged with an offense |
|
|
other than a Class C misdemeanor who fails to appear in court when |
|
|
summoned. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2009. |
