A BILL TO BE ENTITLED
 
AN ACT
  relating to imposing a duty on a sheriff to report certain warrant
  or capias information to a national database.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 2, Code of Criminal Procedure, is
  amended by adding Article 2.195 to read as follows:
         Art. 2.195.  DUTY TO REPORT WARRANT OR CAPIAS INFORMATION.  
  Within 30 days of the day the court clerk issues the warrant, the
  sheriff shall report to the national crime information center each
  warrant or capias issued for a defendant charged with an offense
  other than a Class C misdemeanor who fails to appear in court when
  summoned.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2009.
