A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the powers and duties of the Nueces County Water Control |
|
|
and Improvement District No. 4; providing powers of eminent domain. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 75, Acts of the 57th Legislature, |
|
|
Regular Session, 1961, is amended by adding Section 5A to read as |
|
|
follows: |
|
|
Sec. 5A. (a) The District has the powers and duties |
|
|
provided by the general laws of this state, including Chapters 49 |
|
|
and 51, Water Code, applicable to a water control and improvement |
|
|
district and the powers and duties provided by the general laws of |
|
|
this state, including Chapter 36, Water Code, applicable to a |
|
|
groundwater conservation district. |
|
|
(b) Notwithstanding Section 49.002(b), Water Code, in case |
|
|
of any conflict between provisions of Chapters 36 and 49, Water |
|
|
Code, applicable to the District, Chapter 49, Water Code, controls. |
|
|
SECTION 2. This Act takes effect September 1, 2009. |
