A BILL TO BE ENTITLED
 
AN ACT
  relating to the powers and duties of the Nueces County Water Control
  and Improvement District No. 4; providing powers of eminent domain.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 75, Acts of the 57th Legislature,
  Regular Session, 1961, is amended by adding Section 5A to read as
  follows:
         Sec. 5A.  (a) The District has the powers and duties
  provided by the general laws of this state, including Chapters 49
  and 51, Water Code, applicable to a water control and improvement
  district and the powers and duties provided by the general laws of
  this state, including Chapter 36, Water Code, applicable to a
  groundwater conservation district.
         (b)  Notwithstanding Section 49.002(b), Water Code, in case
  of any conflict between provisions of Chapters 36 and 49, Water
  Code, applicable to the District, Chapter 49, Water Code, controls.
         SECTION 2.  This Act takes effect September 1, 2009.
