CONCURRENT RESOLUTION
|
|
|
WHEREAS, Senate Bill No. 1492 has been adopted by the house of |
|
|
representatives and the senate and is being prepared for |
|
|
enrollment; and |
|
|
WHEREAS, The bill contains technical errors that should be |
|
|
corrected; now, therefore, be it |
|
|
RESOLVED by the 81st Legislature of the State of Texas, That |
|
|
the enrolling clerk of the senate be instructed to correct SECTION 3 |
|
|
of the bill by striking Section 39.452(i), Utilities Code, as added |
|
|
by House Committee Amendment No. 1, and substituting the following: |
|
|
(j) Notwithstanding any other provision of this subtitle, |
|
|
in awarding a certificate of convenience and necessity or allowing |
|
|
cost recovery for purchased power by an electric utility subject to |
|
|
this section, the commission shall ensure in its determination that |
|
|
the provisions of Sections 37.056(c)(4)(D) and (E) are met and that |
|
|
the generating facility or the purchased power agreement satisfies |
|
|
the identified reliability needs of the utility. |
