A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing the legislature |
|
by general law to permit counties to impose a local motor fuels tax |
|
and an additional vehicle registration fee to be used for |
|
transportation purposes. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article III, Texas Constitution, is amended by |
|
adding Section 52k to read as follows: |
|
Sec. 52k. (a) The legislature by general law may: |
|
(1) authorize a county to enact: |
|
(A) a local tax on the sale of gasoline and diesel |
|
fuel in the county; and |
|
(B) an additional vehicle registration fee on a |
|
vehicle registered in the county; and |
|
(2) prescribe the types of transportation projects for |
|
which the revenue may be used. |
|
(b) Section 7-a, Article VIII, of this constitution does not |
|
apply to a tax authorized by this section. |
|
SECTION 2. Section 9(c), Article VIII, Texas Constitution, |
|
is amended to read as follows: |
|
(c) The Legislature may authorize an additional annual ad |
|
valorem tax to be levied and collected for transportation projects |
|
[the further maintenance of the public roads]; provided, that a |
|
majority of the qualified voters of the county voting at an election |
|
to be held for that purpose shall approve the tax, not to exceed |
|
Fifteen Cents ($ .15) on the One Hundred Dollars ($100) valuation of |
|
the property subject to taxation in such county. |
|
SECTION 3. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 3, 2009. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment authorizing the |
|
legislature by general law to permit counties to impose a local |
|
motor fuels tax and an additional vehicle registration fee to be |
|
used for transportation purposes." |
