A JOINT RESOLUTION
|
|
|
proposing a constitutional amendment providing that the holdover |
|
|
provision of the Texas Constitution does not apply to a member of |
|
|
the Texas Transportation Commission. |
|
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 17, Article XVI, Texas Constitution, is |
|
|
amended to read as follows: |
|
|
Sec. 17. (a) All officers within this State, other than a |
|
|
member of the Texas Transportation Commission whose term has |
|
|
expired, shall continue to perform the duties of their offices |
|
|
until their successors shall be duly qualified. |
|
|
(b) A member of the Texas Transportation Commission whose |
|
|
term has expired may not continue to perform the duties of a member |
|
|
of the commission, and a vacancy is created in the member's |
|
|
position. |
|
|
SECTION 2. This proposed constitutional amendment shall be |
|
|
submitted to the voters at an election to be held November 3, 2009. |
|
|
The ballot shall be printed to permit voting for or against the |
|
|
proposition: "The constitutional amendment providing that the |
|
|
holdover provision of the Texas Constitution does not apply to a |
|
|
member of the Texas Transportation Commission." |
